V*' <br />I)Z <br />ih-\ <br />s ’ <br />/iftT;.».—» <br />f / <br />J J « • ^ <br />>- • <br />The Council would not adversely affect the spirit, purpose and intent of the Code <br />and the RR-IB classification by granting the Mr. Gostten ’s request for a lot area variance. <br />Granting the variance request would allow the Property to be subdivided (assuming <br />approval of the concurrent subdivision application) into two lots which would correspond <br />approximately to the Residence Parcel and the Unsewered Parcel. The resulting lots <br />would be a 1+ acre lot for the existing residence and a 2+ acre unsewered lot. The only <br />new building site, then, resulting from the granting of the variance request would be the <br />2+ acre unsewered lot. The new building site would meet all of the current zoning <br />regulations of the zoning classification RR-IB, including all City on-site sewage treatment <br />requirements. (Having stated thus, Mr. Goetten would support a proposal by the City to <br />have the new building site connected to public sewer in the future.) Granting the <br />variance request would not create any new, substandard building sites. <br />The proposed subdivision which is based on the variance request also complies <br />with the qualifications set forth in Resolution No. 1178 when the Council first addressed <br />the unique to the Property and arguably approved a future subdivision. In <br />fact. Resolution No. 1178 is entitled "Resolution of the City County No. 1178 Determining <br />That One Sanitary Sewer Service Will Be Provided For The Property Located At 1385 Fox <br />Street, And Deterniining_Stgnd^dsJqr Anv Future Subdivision of The Property. <br />Resolution No. 1178 reads in pertinent part: <br />1 Any future subdivision of the property must leave not less than one acre <br />for the existing residence. <br />2. Any new building site which might be created will comply with all <br />current zoning regulatiora at tiie time of subdivision, the intent of this <br />provision being that any new lot created in the future is not intended to be <br />served by the 80-1 sewer project but is intended to fully comply with all <br />City on-site sewage treatment requirements. <br />‘1•J <br />i <br />i <br />i
