Municipal Code Section 11.10, <br />Subd. 14 "Special Reqairements for Plata", states in Item A, <br />toning Regulations^ "Every plat shall oonfoni to existing zoning <br />regulations and subdivision regulations applicable at the tiae of <br />final plat approval. Variances shall not he approved to increase <br />the overall subdivision density above the einieua lot area <br />requireaents of the applicable zoning district and this chapter." <br />This code wording was adopted as part of the 1984 recodification. <br />The subdivision code in effect at the time of Resolution No. <br />1178 listed the following policy: <br />39.140. General Requirements: Lots. <br />1. Residential lots, as to size and area, shall be <br />governed by and subject to the policy of the City Council. <br />Such policy, for the promotion of health, welfare, <br />sanitation and the like, is declared to be in favor of <br />relatively large lots so that problems Involving sewage, <br />drainage and cess pools may be minimized and so that the <br />healthy, open and uncrowded aspect of the City may be <br />maintained. Further the policy shall be that all lots <br />conform in area to the existing lots in the general area of <br />the proposed subdivision, and conform to the minimum <br />building sizes established by Chapter 32. <br />Applicant proposes Lot 1 at 2.01 dry buildable acres <br />(excluding existing roadways) and Lot 2 at 1.00 dry buildable <br />acres. <br />Soiling History <br />Prior to July 10, 1950, the property was not zoned. From <br />July 10, 1950 until September 14, 1967 the property was zoned <br />"Orono District", a residential district requiring a 1.5 acre <br />minimum lot size. From September 14, 1967 until January 1, 1975 <br />the property was zoned R-IB, one family residential, again <br />requiring a 1.5 acre lot alze. From January 1, 1975 to the <br />present, the property has been zoned RR-IB, one family rural <br />residential zoning district requiring a 2 acre minimum lot size. <br />I <br />1 <br />" - --- -
