--- <br />s 10.41 <br />A. Otherwise meets all of the provisions of this <br />Chapter <br />B. Submits a detailed landscape plan showing <br />sufficient planting and landscaping in each of the four years in <br />order to provide at the end of the four years a natural screen that <br />will not be less than 50% opaque during the summer months. <br />C. Submits four year planting and landscaping plan <br />which shall provide that in each year of the plan, at least 25% of <br />the necessary landscaping and planting (as determined by the <br />Council as of April 15, 1975) be planned, bonded and completed for <br />each required landscaping area according to the other provisions of <br />this Chapter. The Council may vary this requirement in order to <br />allow a higher percentage of the landscaping and planting in any <br />required landscaping area and credit the applicant for the <br />landscaping and planting which otherwise would be required in other <br />landscaping areas. <br />Subd. 15. Regulations Relating to Location, <br />Construction, Installation and Maintenance of Docks, Boat Mooring <br />Areas and Other Fixed or Floating Structures and Objects on Lakes - <br />Adoption by Reference. The City hereby adopts by reference and <br />makes a part of this Chapter as if fully set forth herein^ the <br />following: Ordinance No. 1 of the Lake Minnetonka Conservation <br />District as adopted on January 28, 1970; Amendment to Ordinance No. <br />1 as adopted on May 27, 1970 by the Lake Minnetonka Conservation <br />District; Amendment No. 2 to Ordinance No. 1 as adopted <br />28. 1971, by the Lake Minnetonka Conservation District. The city <br />expressly reserves the right to deny any variance to the provisions <br />of Ordinance No. 1 as amended, even though the same variance was <br />granted by the Lake Minnetonka Conservation District. <br />Ordinances are declared invalid by a court of <br />jurisdiction, no marina shall have a <br />or more boat buoys than what was permitted by the terras of that <br />ordinance on the date it was declared invalid, or than was last <br />approved by the Lake Minnetonka Conservation District, whichever is <br />less The City expressly reserves the power to be mote^ restrictive <br />in its regulation^ than the Lake Minnetonka Conservation District <br />Ordinances^ if the public health, safety and welfare of the citizens <br />of Orono so requir:^s. <br />ORONO CC 342 (4-1-84)
