The <br />flood fringe district shall include those areas designated <br />as floodway fringe in the Flood Isurance Study including <br />without limitation the shoreline of Lake Minnetonka between <br />elevations 929.4 and 931.5, the area between the floodway <br />and the edge of the 100-year flood elevation. Review <br />Exhibit S. Mote that new construction will be located <br />entirely within flood fringe area. Septic tanks and <br />drainfield areas are located above the flood plain elevation <br />at 931.5 <br />Section 10.55, Subd. 7 (B) - The regulatory flood protection <br />elevation for Lake Minnetonka shall be 932.5 MSL. <br />Section 10.55, Subd. 8 - Development restricted. No <br />filling, grading, temporary or permanent structures 111 be <br />allowed within the flood plain. <br />Section 10.55, Subd. 10 - Permitted and conditional use <br />permits. Only structures allowed within flood fringe area <br />are listed under conditional uses. They are accessory <br />structures such as open decks and patio or other accessory <br />uses not specifically listed when approved by the Council <br />but no use shall be approved which will restrict or obstruct <br />any flood flow or which will raise the level of any flood <br />flow. Seasonal structure use is not addressed. <br />Sfection 10.55, Subd. 14 (B) - Conditions attached to <br />conditional use permits. Flood proofing measures in <br />accordance with State Building Code and Federal Flood <br />Regulations - Applicant shall submit the plan or document <br />certified by a registered professional engineer or architect <br />that the flood proofing measures are consistent with the <br />regulatory flood protection elevation and associated flood <br />factors for the particular area.
