Additional septic testing has been completed. The <br />applicants have staked the new right-of-way lines so that Stephen <br />Weckman has been able to confirm the 10' setback. (P»eview Exhibit M.) <br />The subdivison is now proposed as a plat as the City will ask for <br />drainage easements over the swale and the channel area to the east <br />side of both parcels. The new right-of-way shall be dedicated as well <br />as customary drainage and utility easements along the perimeters of <br />each lot. <br />Options of Action <br />Denial. <br />Approval. In the original review, the City held that it was <br />important to obtain at least 8 1/2' of right-of-way based on the <br />potential development of properties to west and north. <br />(Applicant would withdraw application if 17' was required.) <br />Review Exhibit J. Conceptual transportation plan for immediate <br />area developed by staff as a result of other subdivisions <br />proposed to the immediate north and west of the property. <br />Approval of the lot line rearrangement will require approval of a <br />lot width variance. The following findings can be made: <br />1.Applicant has attempted to acquire additional lands to the <br />north and was denied by owner based on future development <br />plans for the property. <br />2. <br />3. <br />Lot was already created at a substandard lot width in 1976. <br />The additional lot width will provide additional area for <br />suitable septic development of mound systems. <br />The following conditions may be considered with an approval <br />recommendation : <br />1.Applicant to create covenants defining location of septic <br />areas to be filed in chain of title. This must be done to <br />insure septic sites are protected prioi to development and <br />after development because this will be the only suitable <br />areas for septic development for residential use. <br />2.Septic areas must be staked prior to the issuance of <br />building permits for new residential construction on either <br />lot. <br />3.Granting of drainage easements 15' either side of the center <br />line of the swale and over the northeast and east side of <br />property where channel intersects the subject property.
