Ms. Jean Mabusth <br />October 6, 1992 <br />Page 4 <br />boulder retaining walls to promote sxibsurface absorption. Although <br />these improvements add 744 square feet to the hardcover <br />calculation, they are necessary to slow erosion and control <br />groundwater runoff. <br />Mr. Hollander proposes removing a portion of the deck and the <br />gazebo, as well as additional hardcover. The removed portion of <br />the deck will be converted to a flower bed, allowing percolation. <br />The old gravel driveway and plastic erosion control around the <br />house will also be removed. This provides a reduction of 812 <br />square feet of hardcover, 449 scpiare feet in the 75 foot to 250 <br />foot setback zone and 389 square feet in the zero foot to 75 foot <br />zone. A diagram of the proposed changes is included. <br />Mr. Hollander believes that he has a right to the deck as a <br />grandfathered, non-conforming use, but wishes to work with the City <br />to resolve this question. Mr. Hollander is requesting a variance <br />to comply with current city ordinance requirements, and is willing <br />to remove a portion of the deck and other existing hardcover.^ We <br />hope that the City will appreciate the dilemma Mr. Hollander finds <br />himself in recognizing the pre-existing construction and the unique <br />limitations of this lot in granting him this variance application. <br />Very truly yours. <br />REED & POND, M157\ <br />Richard N.
