I <br />Zoning Pile #1757 <br />July 16, 1992 <br />Page 2 <br />Description of Request <br />The subject guest house will be formally recognized as a non- <br />conforming structure in the approval resolution of the final plat for <br />the applicant. Based on the information submitted with the <br />preliminary survey, the guest house appears to be completely located <br />within the 100* setback. Any major structural repairs for any <br />expansions located within the protected area will require variance <br />approvals. It should be noted that the non-conforming setbacks did <br />not result from the lot lines created with this three lot subdivision. <br />The guest house shall continue to be used by applicant, guests or <br />hired help. <br />During the preliminary review of the subdivision, applicant's <br />septic consultant provided additional information confirming that <br />there is adequate area for alternate septic sites for both residence <br />and guest house. It is the intention of the City to require the <br />installation of a new septic system if guest house use is to be <br />continued. The City has also asked for confirmation of additional <br />areas suitable for septic expansion. Mark Gronberg has advised that <br />the original test site can be used for the installation of the primary <br />system and that the area can be expanded as an alternate site to serve <br />both residence and guest house at a future date. <br />The issue as to when the new system was to be installed was never <br />specified during the preliminary subdivision review. The staff memo <br />suggested a deadline of one year from the date of final plat approval. <br />Review Exhibit E, Weckman's memo requests ninety days from the date <br />of Council's approval of the conditional use permit to be consistent <br />with requirements of septic code. <br />Staff Recoi dation <br />To approve the conditional use permit for the continued guest <br />house use of the secondary residential vtructure on the prrr>erty <br />located at 1685 Fox Street finding that all area requirements for the <br />guest house use have been met. <br />This approval is subject to the following conditions: <br />1.Guest house structure is considered a non-conforming <br />structure. Based on its substandard side setback at 10' and <br />substandard lakeshore setback at approximate!;’; "’O', any <br />major structural repair of this structure or ’-'ion of <br />this structure will require variance approval ot the. City of <br />Orono. <br />2.The guest house is for the exclusive use of applicant, <br />guests or hired help and may never be used for rental <br />purposes.
