Zoning File #1760 <br />August 12, 1992 <br />Page 2 <br />I <br />Description of Request <br />Applicant proposes to reconstruct a split level residence on the <br />vacant property. The original house was razed in May of 1991 as a <br />result of a hazardo»3s building action. The property has been assessed <br />for sewer and a SAC payment was made in 1988. There is no record of <br />the location of the original house on the property but it was <br />approximately in the same alignment of the existing residences which <br />appear to be within 10-15' of the street/front lot line. The proposed <br />house will meet the front 50' setback but will not meet the required <br />side or rear setbacks. Note the irregular east side lot line places <br />deck approximately 10' from rear lot line. The principal structure at <br />that point is located 22'. Applicant should be asked to consider <br />relocating deck further west on property and still allow an access <br />door from upper level kitchen. <br />The property is not subject to the hard cover regulations of the <br />City as property is not located within 1,000' of a protected lake. <br />The improvement plan meets the lot coverage requirements. <br />Staff has reviewed the files to see if expenses charged against <br />the property for the hazardous building action have been paid. The <br />files reveal that the amount of $2,181.39 still remains to be paid to <br />the City. Applicant must make payment of the full amount upon <br />application for a building permit. <br />The lot is a through lot. All future accessory structures to be <br />installed on the property will require a conditional use permit. <br />Access to the property will remain via Prospect Avenue where lot is at <br />its widest width at 93'. <br />Hardship Stateaent <br />Please review Exhibit A. Applicant notes that lot is less than <br />1/2 acre in area and subject to 2 acre development standards. The lot <br />is typical in size of the surrounding Crystal Bay neighborhood. A <br />residence had existed on the property before and the property is <br />served with sewer and has been assessed a single sewer unit. <br />Issues for Consideration <br />1. Can the number or intensity of setback variances sought be <br />minimized? Legal building envelope would measure 33' in <br />width. Lot depth does not appear to be an issue. <br />2. Is the proposed development plan for this property similar <br />to the pattern of development for the Crystal Bay <br />neighborhood?
