Lawrence, 1550 Sixth Avenue North <br />Conditional Use Permit - Public Hearing <br />Pertinent Ordinance <br />Section 10.28, Subd. 3 - Conditional use permit required for <br />continuation of guest house use. <br />List Of Bxhibita <br />A - Application <br />B - Property Owners List <br />C > Plat Map <br />D > Septic Report <br />E - Septic Map <br />P - Survey <br />Description of Request <br />During the review of applicant's two lot preliminary plat <br />(Application #1749), the applicant was advised of the need to file a <br />conditional use permit if the secondary structure on Lot 1 was to <br />continue to be used for guest house purposes. The septic testing <br />submitted for the preliminary subdivision confirms the existing septic <br />system conforms to the new setback standards of the Shoreland <br />Regulations for protected tributaries meeting the 75' setback. New <br />septic testing confirms adequate and suitable area for an alternate <br />site serving both principal structure and guest house. <br />As was noted in the review of the preliminary subdivision <br />application, staff advised that a building permit was issued in 1967 <br />for the guest house. The conditional use permit was not required even <br />though the code clearly at that time would have required a conditional <br />use permit. There was mention of a future subdivision that would <br />relocate the guest house structure on a separate lot. Note guest <br />house is located 25' from principal residence. Principal residence <br />was installed in 1960. Staff would recommend that if this property is <br />to ever be subdivided in the future that the guest house structure <br />could be converted into an accessory structure that could now be <br />located 10' from a future division line (structure less than 750 s.f. <br />in area). Total lot aiea at 4.42 acres meets the area standard <br />required for guest house use. <br />i
