’ J. <br />Zoning File #1729 <br />April 16, 1992 <br />Page 4 <br />m r> <br />It is recommended th?ti the applicant at this time have a <br />surveyor confirm the dry buildable envelope of the remaining <br />contiguous property within Lot 56. If the surveyor provides this <br />certification in area, applicant need not combine remaining Lot <br />56 with his homestead parcel. As currently proposed, the City <br />must require the legal combination with Rood's homestead parcel. <br />The applicant should also consider the impact of the separation <br />of Lot 56 from the homestead parcel. If Lot 56 is to be <br />developed as a building site, the homestead parcel will lose <br />control over the majority of the now shared improvements. Staff <br />strongly recommends that Mr. Rood consider the impact of <br />current subdivision and his comprehensive plan for the <br />development of this property. Rood may be well advised to alter <br />this application to a two or three lot plat. <br />Options Available to Applicant <br />Mr. Rood has the following options concerning the proposed <br />lot line rearrangement subdivision application; <br />1. <br />pi <br />Proceed with the current meets and bounds lot line <br />rearrangement and amend the current alignment so that there <br />is 1/2 acre dry buildable land within the proposed building <br />site. <br />ill r <br />If applicant provides confirmation that remaining Lot 56 has <br />1/2 acre of dry contiguous land to the immediate east of the <br />proposed building site, applicant need not legally coml^ne <br />presented^foif\he^ City's review, remaining parcel 56 would <br />have to be combined with Rood's homestead. <br />OR <br />To refile a Class II subdivision of a replat of two or three <br />lots with the inclusion of the homestead parcej. <br />Platting of this property will also simplify the problems <br />with filing the Conservation and Flowage Easement required <br />in Application #1604. <br />Staff Rec<♦' IM t • i#latlon <br />staff would recommend that the subdivision application be <br />tabled until applicant has determined how he wishes to proceed <br />with the comprehensive development of the property and to provide <br />the City with the necessary information to complete that <br />subdivision. Any condition of approval will require that <br />applicant prepare the appropriate Certificates of Title and deeds <br />so that the required documentation can be filed against the Chaxn <br />of Titles of the properties.
