§ 10.56 <br />Subd. 8. Establishment of Shoreiand Overlay District. <br />The Shoreiand Overlay District is hereby defined and established to <br />include the following lands within the City of Orono: <br />11 <br />.•••'V <br />■VU >// • ' <br />I y ■' <br />.i <br />f.' ‘ ''fci" <br />i ^ <br />A. All lands within 1000' of the Ordinary High <br />Water level of the lakes classified Natural Environment, <br />Recreational Development, and General Development in Subdivision 7 <br />of this section. The Shoreiand Overlay District includes lands <br />within Orono that are located within 1000 ’ of lakes located in <br />adjacent cities, namely Hadley Lake in the city of Plymouth and <br />Wolsfeld Lake in the city of Medina. <br />B, All lands within 300' of the Ordinary High <br />Water level of the watercourses classified as tributary streams in <br />Subdivision 7 of this section. Where the flood plain of said <br />tributary streams as defined in Section 10.55 or as defined <br />elsewhere in the Orono Zoning Code extends further than 300' from <br />the Ordinary High Water level, the boundary of the Shoreiand <br />Overlay District shall be extended to include those areas <br />designated as flood plain. <br />Subd. 9. Interpretation of District Boundaries. In <br />their interpretation and application, the provisions of this <br />section shall be held to be minimum requirements and shall be <br />liberally construed in favor of the City and shall not be deemed a <br />limitation or repeal of any other powers granted by State Statutes. <br />The boundaries of the Shoreiand Overlay District shall be <br />determined by scaling distances on the official map. Where <br />interpretation is needed as to the exact location of the boundaries <br />of the district as shown on the official map, the City Engineer <br />shall make necessary interpretation based on the Ordinary High <br />Water level. The person contesting the location of the district <br />boundary shall be given a reasonable opportunity to present his <br />case to the City and to submit technical evidence if he so desires. <br />Subd. 10. Land Alteration and Building Permits Required. <br />A permit is required for the construction of buildings, building <br />additions, related work such as construction of decks and signs, <br />installation or alteration of sewage treatment systems, grading and <br />filling activities, and other activities as regulated elsewhere in <br />the City of Orono Municipal Code. <br />Subd. 11. Certificate of Zoning Compliance. The Zoning <br />Administrator shall issue a Certificate of Zoning Compliance for <br />each activity requiring a permit as specified in Subdivision 10 of <br />this section. This Certificate will specify that the use of land <br />conforms to the requirements of this ordinance. Any use, <br />arrangement, or construction at variance with that authorized by <br />permit shall be deemed a violation of this ordinance and shall be <br />punishable as provided in Subdivision 6 of this section. <br />ORONO CC 376-7 <br />*—
