'■si <br />Zoning Application #1704 <br />January 15, 1992 <br />Page 3 <br />The applicant has filed the necessary permit application <br />with the Minnehaha Creek Watershed District. Prior to the City <br />issuing a land alteration permit to complete the project, the <br />City must be in receipt of the permit from the Watershed <br />District. <br />Hardship Statement <br />Please review the application. Exhibit A. <br />noted as follows: <br />Hardships are <br />1.There were never any plans or improvements made to the <br />drainage channel at the time the formal drainage <br />easement was created with the approval of the plat in <br />1970. <br />2.Current drainageway cannot handle large rainfalls <br />causing flooding in the back yards. <br />Dead trees pose a hazard in windstorms and create hours <br />of clean-up after 15 m.p.h. winds. <br />As the drainage improvement already installed by Mr. Madge <br />involves hardcover, the applicant was asked to provide a <br />hardcover inventory of the property. Staff has briefly reviewed <br />those hardcover facts and notes that the hardcover areas have <br />been designated appropriately but staff cannot confirm upon a <br />site inspection whether all hardcover has been designated because <br />of snow cover. Hardcover is reported as follows: <br />0-75' setback area = <br />75-250* setback area <br />250-500' setback area <br />5.93% (this may be area of riprap) <br />4.66% <br />33.64% <br />There is a 20* wide utility easement that intersects the <br />lakeshore yards of the subject properties. The easement is not a <br />sewer easement as the sev/er lines are located within Forest Arms <br />Lane. The City must ask for documentation confirming that the <br />appropriate utility company or agency has been advised of the <br />proposed land alterations and that said land alterations will <br />have no impact. <br />Options of Action <br />If application is to be denied, please refer to the <br />necessary findings in the variance and conditional use permit <br />sections of your code. If denial includes the removal of <br />riprap/grout area adjacent to roadway, please provide a suggested <br />deadline date for the removal of the facility.
