The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property. <br />Response: The condition and goals are to essentially "clean up" the property issues created years <br />prior when the guest house was parceled off for a previous owner such as the driveway easement, <br />nonconformities, and the average lakeshore set back inconsistency, and to allow the guest house to <br />continue with its historic use. <br />9. The conditions do not apply generally to other land or structures in the district in which <br />said land is located. <br />Response: The property originally was a guest house and the goal of the ADU designation request is <br />to combine it with the original property and allow it the historical use of over 75 years. <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />Response: The granting of the application will grant the historic use of the dwelling. <br />11. The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />Response: Granting the proposed variance will not impair health or safety. No changes are being <br />made to the property other than removal of hardcover as presented in LA21-000078. <br />12. The granting of such variance will not merely serve as a convenience to the applicant <br />but is necessary to alleviate demonstrable difficulty. <br />Response: The single-family home presently exists and is a finished residential home with the <br />historical use as a dwelling and/or guest house of the original property. <br />Water-sewer was recently updated which was a requirement of the City of Orono so the home could <br />be sold. <br />Gas/Electricity was separated from the original property when the guest house was parceled off to a <br />separate owner. <br />Without the variance it renders the existing home unusable.
