Applicant shall submit proposed Conservation Easement language for Council review <br />and acceptance, specifying ^ proposed conditions and limitations to be placed on Outlet <br />B and the additional areas not^ above. The easement shall incorporate as a minimum, <br />the following elements: no structures allowed, no fences, no domestic animals (i.e. no <br />horses, sheep, chickens^ etc.), no tree or vegetation removal except by special permit for <br />maintenance or as part of an approved vegetation management plan, no excavating or <br />earth movement; creation and maintenance of non-hardcover walking paths may be <br />allowed. <br />Permanent markers of a design and material acceptable to the Planning Director shall <br />be placed at all points where the Conservation Efuement intersects a lot boundary or <br />v4iere the Easement boundary line changes direction, as noted on attached E.\hibit B. <br />3.Prior to final plat approval, the developer shall submit an Ecological Restoration and <br />Management Program developed by a qualified ecologist, for city acceptance. Such <br />Program shall be implemented and adher^ to, subject to a Developers Agreement to be <br />executed between the Developer and the City. <br />Limitations on Individual Lots. <br />Accessory structures: Accessory structures may be placed on lots according to <br />City standards, with the following exceptions: <br />For Lot 1, Block I, no accessory structure shall be placed within 150* of <br />the west property boundary, in order to protect tested sewage treatment <br />system sites. <br />For Lot 2, Block 1, no accessory structure shall be placed within 130* of <br />the west property boundary, in order to protect tested sewage treatment <br />system sites. <br />For Lot 3, Block 1, no accessory structure shall be placed within 135* of <br />the west property boundary, in order to protect tested sewage treatment <br />system sites. <br />The lot size for administering accessory structure ordinances shall be the actual <br />contiguous dry buildable lot area; for Lots 1,2 and 3, Block 2, the contiguous dry <br />buildable area contained within tlie Conservation Easement shall be creditable for <br />administering accessory structures ordinances. <br />Page 6 of 13 <br />T <br />n <br />1*^
