Your letter has bera forwarded to the City <br />Council and will be provided to the Plamiing Commisston in their next packet regarding <br />this application. <br />Please note that the Planning Committion tabled the application on June 30. The <br />attached Notice of Planning Commission Action provides additional detail regarding the <br />tabling. <br />To address the many specific questions raised in your tetter, 1 would oflcr the following: <br />The municipal parking lol and the accesses to it are the result of acquisition <br />in the mid-l9fi0's of ftt title to (or in some cases easements over) a variety of <br />parcels. Staff has not researched how much was paid for the lot Construction of <br />die actual parking lot wu aasested to abuiling OMmtn shoitly after ita acquisilion. <br />The City maintains the lot. The <br />applicant's submitted plans indicate walls/fences totaling no more than 5.5* in <br />height However, if the walls/fences were lo exceed 6' in height, the additional <br />area enclosed by such walls for the rear patios would be approximately 1600 i f., <br />increasing the lot coverage by strucnire to approximately 50*4 <br />The City hu not made a deteimination regarding the placement of trees within the <br />sidewalk. <br />Orono't noise ordinances are primarily contained within Sections 5S-116 through <br />58-123 (attached) and are enforced by the Police Depaitment The zoning code <br />provisions for noise arc contained within Section 78-1568 fattached) which are <br />admimstered by the Plaiming and Zoning Department.. <br />I would refer you lo the Orono Police Department (952-249-4700) directly for <br />information on police calls regarding the Nanows <br />Planning and Zoning Department files do not contain a specific report in response <br />to Condition #3 of Resolution No. 4530 establishing a one-year review of “the use <br />of the building in relaCioa lo the bve entertainment and noise levels generated by <br />the Kve enteftainmciit use“.
