#0S^I21 NMrrowi Saloon Expanfion <br />October 6,2005 <br />Page 12 <br />MoratorHiiii Impact <br />Sln<» the July 15, 2005 Planning Commission public hearing, the Council adopted <br />Ordinance No. 26, Third Series, establishing a moratorium with respect to development in <br />the Navarre area. The Council indicated at the time the moratorium was adopted that the <br />Narrows application was not intended to be subject to the moratorium; however, the language <br />of the moratorium ordinance erroneously does not specifically exclude the Narrows, or any <br />other properties for which a zoning application was made prior to the moratorium cflfective <br />date. <br />The moratorium ordinance is attached as Exhibit I of the Sept. 16 PC memo. ITie City <br />Attorney has recommended that if Council is still of the same mind and so chooses, the <br />moratorium language error can be corrected by simply amending the language to exclude any <br />properties in the defined moratorium area which had zoning applications pending at the time <br />the moratorium was adopted. <br />Staff Recommendation <br />Staff would offer the following as general and specific guidelines for issues to be considered <br />by the Council with regards to this CUP application; <br />1.Is the proposed location of the use in accord with the objectives of the Zoning <br />Code and the purposes of the B-1 District and the Comprehensive Plan? <br />2.Will the location of the proposed use and the proposed conditions under which it <br />will be operated or maintained be detrimental to the public health, safety welfare, <br />or be materially injurious to properties or improvements in the vicinity? <br />3.Is the proposed use compatible with the surrounding business di.strict and <br />residential neighborhoods? If not, what aspects of the use make it incompatible? <br />What methods are available to mitigate those aspects? <br />4.Is tlw proposed use supported by adequate infrastructure, primarily access and <br />parking availability? How will o^er users of the municipal lot be affected by the <br />expansion? How might the expansion affect future development or reinvestment <br />in Navarre? <br />Council should provide direction to staff and applicant as to how this application should <br />proceed.
