J <br />A RESOLUTION REGARDING THE USE <br />OF THE DAKOTA RAIL CORRIDOR <br />WHEREAS, the Hennepin County Regia,:.. Railroad Authority (HCRRA) now has <br />ownership of the Dakota Rail Corridor; and <br />WHEREAS, the City of Orono has consistently supported the preservation of the <br />corridor as a continuous public transportation corridor, and has supported the development of a <br />regional recreational trail along the entire length of the corridor; and <br />WHEREAS, as the HCRRA has jurisdiction over the corridor, and their rules apply to <br />the use of the corridor, the City will support the management of the corridor by the HCRRA to <br />ensure the preservation of the corridor as a continuous public transportation corridor, and <br />WHEREAS, the HCRRA is in the process of developing policies regarding the private <br />use of the right-of-way in the corridor; and <br />WHEREAS, on-going public use of the corridor, such as for a regional recreational trail, <br />will discourage unauthorized etKroachments onto the corridor for private uses; and <br />WHEREAS, it is important that any private use of any portion of the right-of-way in the <br />corridor be managed in a way that preserves the ability to use the entire corridor as a continuous <br />public transportation corridor in the future; and <br />WHEREAS, any private use of the corridor should be managed through a written <br />agreement that provides for the use on an interim basis, but enables the HCRRA to terminate the <br />agreement when the land is needed for a public transportation use; and <br />WHEREAS, exceptions to this can be made where there are historically-used crossings <br />of the corridor for access to private properties. <br />NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council does hereby <br />confirm its support for the preservation of the Dakota Rail Corridor as a continuous public <br />transportation corridor, and for the development of a regional recreational trail along the entire <br />length of the corridor. <br />Page 1 of 2 <br />f .
