4. <br />5. <br />a. While the 1992 and 1995 variances approved a front yard setback of <br />25 feet, the 23 feet that exists today was unintentional. <br />b. The proposal includes no hirther measurable encroachment to the <br />existing fixmt yard of Barrett Avenue, and will have no negative <br />impacts to the neighborhood. <br />c. All other Zoning Ordiiumce requirements with respect to structural <br />coverage, side and rear yard setbacks, and building height are met. <br />The property is not located within a hardcover zone. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the iqiplicant and the public, and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance would not adversely affect traffic <br />conditions, light, air nor pose a fire hazard or other danger to neighboring <br />property; would not merely serve as a convenience to the iqjplicants, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicants; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive <br />Plan of the City. <br />CONCL USIONS, ORDER AND CONDITIONS <br />Baaed upon one or more of the above findings, the Orono City Council hereby <br />grants a front yard setback variance per Orono Municipal Zoning Code Section 78-420 <br />(B) to permit construction of a garage addition onto the existing home including a screen <br />porch above the easterly 20’ x 15.5 ’ of the addition to be located 22.8’ from the front lot <br />line where a 50 ’ aetbink is normally required, and a covered entry, subject to the <br />following conditions: <br />1.
