VOTE: Ayes S, Nays 0. 6. #05-3091 CATHERINE SALLAS, 3635 NORTH SHORE DRIVE - AFTER-THE-FACT VARIANCE Catherine Sallas, Applicant, was present. Curtis stated the applicant is requesting after-the-fact lake and side setback variances and a 0-75 ’ hardcover variance to allow an existing roof top deck to remain SO feet from the lake and nine feet from the southwest lot line on toe roof of the existing home. The neighboring property owners have provided additional written comments and photos illustrating their concerns. The Planning Commission voted 4-3 to recommend approval of the after-the-fact variances in conjunction with removal of all portions of the existing grade-level deck that extend lakeward of the average lakeshore setback. Planning Staff recommends approval of toe after-the-fact lake and side setback variances and hardcover variance with the stipulation that an equivalent square footage of hardcover be removed to offset the new hardcover consisting of S2 square feet for the stairs accessing the roof top deck. Murphy inquired whether Staff would be inspecting the deck. Curtis stated Staff would need to inspect it in order to issue a building permit. Oaffion stated it is his understanding the building inspector has previously reviewed the deck and that there are only some minor changes that need to be made to the deck. Curtis stated she has gone up on top of the deck and that it appears to be stable. Murphy indicated he has visited this site and that there appears to be a droop to the roofline, and questioned whether the deck is really structurally stable. Curtis stated the neighbors did provide a photograph of the deck, which may help to illustrate the condition of the deck. Curtis noted the photograph does not depict that portion of the deck clearly.
