A side setback variance for a 3.7’ side setback where 10’ is required, and <br />2. A rear yard setback variance for a 15’ rear yard setback where 30 ’ is normally required, and <br />3. A 75’ - 250 ’ zone hardcover variance for 30.8% hardcover where 25% is normally allowed and <br />30.2% was previously approved, and <br />4. A 250 ’ - 500 ’ zone hardcover variance for 41.8% hardcover where 30% is normally allowed <br />and 46.3% was previously approved and 47.9% currently exists (due to 12 s.f. of hardcover <br />added by the City when the Birch Lane was improved), and <br />5. A structural coverage variance to allow 1,750 s.f. or 18.2% where 1,500 s.f or 15.6% is <br />normally allowed and 1,721 s.f or 18% was previously approved. <br />Planning Commission Recommendation <br />On July 18, Planning Commission voted 6 - 1 to recommend approval of the CUP and variances as <br />follows: <br />1. A rear yard setback variance to allow the detached garage to be closer to the street than 30 ’ as <br />required stipulating that it be located to provide a minimum of 20’ of driveway pavement <br />between the edge of Birch Lane and the garage door. <br />2. A 10’ side setback variance for a 1 ’ story detached garage with a maximum footprint of 440 <br />s.f -OR- a 5 ’ side setback for a single story (maximum 12’ in height) detached garage with a <br />maximum footprint of440 s.f; and <br />3. Hardcover variances in order to support the new garage and driveway construction. <br />1 <br />\
