Lot area variance to permit construction of a new residence on an existing lot 1.5 <br />acres in total area with 0.92 acres considered dry buildable, where 2.0 acres is <br />normally required. <br />2. Conditional use permit to allow 900 cubic yards of fill outside the 75 ’ setback <br />when 500 cubic yards or less is permitted without conditional use approval. <br />Siriff RecorruuetfdatUm: Staff recommends approval of the lot area variance stipulating <br />that the deck on the lake side of the home be confirmed to meet a 30 ’ setback from the <br />side lot line, as no side yard setback variance would be granted, and also that the chain <br />link fence shown within 75 ’ of the lake, within the applicant’s property, be removed. <br />With rega^ to the requested conditional use permit for fill in excess of 500 cubic yards, <br />the Planning Commission should review the applicable Zoning Code Sections and <br />evaluation criteria in Section 78-1250 and determine if any negative impacts will result. <br />II VPertiuent Zoning Ordinance Seel <br />Sec. 78-305.
