5.
b. The former residence existed on the substandard area and width lot
since prior to I960.
c. The lot is provided with City sewer.
d. All other Zoning Ordinance requirements with respect to setbacks,
hardcover, lot coverage by structures, and building height are met.
e. No additional adjacent land is available for acquisition by the
applicants, and doing so would make the adjacent properties more
substandard than already exists.
The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
varianc es on the health, safety and welfare of the community.
The City Council finds that the conditions existing on this property are
peculiat to it and do not apply generally to other property in this zoning
district; that granting the variances would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property: would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
(xeserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a lot area and lot width variances per Orono Municipal Zoning Code Section 78<
330 (B) to permit construction of a new residence on an existing lot O.SO acres in area
where 1.0 acre is normally required and 77’ in width at the shoreline and 79’ in width at
the 7S’ setback where 140 ’ is normally required, subject to the following conditions:
1.
