A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-330(B) <br />FILE NO. 05-3107 <br />WHEREAS, Scott R. Bissen and Michelle R. Morey, husband and wife <br />(hereinafter “the applicants**) are the owners of the property located at 825 Tonkawa <br />Road within the City of Orono (hereinafter the “City**) and legally described as follows: <br />Part of Lots 1 and 2, Auditors Subdivision No. 217, Hennepin County, <br />Minnesota (hereinafter the “property**); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for a variance to Orono Municipal Zoning Code Section 78-330(B) to allow a lot width <br />variance in order to construct a new single fomily residence on a lot 106* wide at the <br />OHWL and 139* wide at the 75* setback where 140* in width is required. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #05-3107. <br />The property is located in the LR-IB, Single Family Lakeshore <br />Residential zoning district, which requires a minimum of 43,560 s.f. or 1.0 <br />acre in area and 140* in width. The applicants* property is 56,553 s.f (1.3 <br />acres) in lot area and 106* in width at the shoreline and 140* in width at <br />the 75* setback line. <br />3.The Planning Commission reviewed this application at a public hearing <br />held on July 18, 2005 and recommended approval of the hardcover <br />variance and conditional use permit based on the following findings: <br />a. No additional land is available for acquisition by the applicants to <br />make the property conforming in area. <br />Page 1 of 5
