Ancillary Code Revisloni <br />Augut 9,2005 <br />Page! <br />Sec, 78-570 RS District Setback Requirements. <br />“(2) <br />a. <br />b. <br />Wells and sewage treatment systems, 75 feet. <br />All structures, land alteration or hard cover of any kind, 3< feet <br />shall meet the setback requirements established within Article <br />XI of Chanter 78 of the Municipal Code (the Wetlands <br />Protection element of the Zoning Code!.” <br />Sec. 78-1211 Shoreland Management - Definitions. <br />"Wetlands shall have the same meaning as the “protected wetlands" <br />defmed in Section 78-1 lOt 78-1 <br />Sec. 78-1286 Shoreland Management - Topographic Alterations/Grading & Filling. <br />**(e) The following considerations and conditions must be <br />adhered to during the issuance of construction permits, grading and filling <br />permits, conditional use permits, variances and subdivision approvals: <br />(1) Orading or filling in any type 2, 3, 4, S, 6, 7 or 8 wetland must be <br />evaluated to determine how extensively the proposed activity would affect <br />the following functional qualities of the wetland: <br />a. <br />b. <br />c. <br />d. <br />e. <br />f. <br />Sediment and pollutant trapping and retention; <br />Storage of surface runoff to prevent or reduce flood damage; <br />Fish and wildlife habitat; <br />Recreational use;. <br />Shoreline or bank stabilization; and <br />Noteworthiness, including special qualities, such as historic <br />significance, critical habitat for endangered plants and animals, or <br />others. <br />This evaluation must also include a determination of whether the wetland <br />alteration being proposed requires permits, reviews or approvals by other <br />sccHons of City oi^inanccs or bv otlier local state or federal agencies <br />including but not limited to watershed districts, state department of natural <br />resources, or the United States Army Corps of Engineers.” <br />In reviewing the Subdivision Code (Municipal Code Chapter 82) staff has found no <br />sections that require revision to be in conformity with the proposed wetland ordinance. <br />1
