D. <br />F. <br />G. <br />H. <br />Chain of Custody • FinlLab will maintain proper chain of custody controls <br />during all testing and/or handling of urine specimens and proper chain of <br />custody documentation. FirstLab will retain custody of any confirmed <br />positive specimens under proper chain of custody and secured refrigerated <br />condition as per standards of the Substance Abuse and Mental Health <br />Services Administration (hereinafter referred to “SAMHSA”). <br />Random Testing - HrstLab will provide participating entities with names <br />of employees to be tested on a random basis in compliance with the annual <br />rates of testing requited by the FMCSA and the FTA. Two separate MCIT <br />random testing **pools” will be established by FirstLab: <br />• one for FMCSA employees and <br />• one for FTA employees. <br />The annual random selection percentages will be applied to the total number <br />of driver positions in each “pool". <br />• Random drug testing will be done at the annual rate of 50% of the <br />average number of driver positions for both the FMCSA and the FTA, <br />• Random alcohol testing must be done at the annual rate of 10% of the <br />average number of driver positions for both the FMCSA and the FTA. <br />• The random tests shall be reasonably spread throughout the calendar <br />year. <br />Record Keeping and Reports for Participating Entitles - FirstLab shall <br />develop and maintain records and reports required by federal and state laws, <br />rules and regulations. These records and reports shall include, but not be <br />limited to: <br />• Verified positive drug and alcohol test results. <br />• Refusals to submit to tests. <br />• Driver evaluation and referrals. <br />• Annual calendar-year suiiunary. <br />• Records related to the alcohol and drug collection/testing process. <br />• Negative and cancelled drug and alcohol test results. <br />• Records related to the drug and alcohol program’s education and <br />training of supervisors and drivers. <br />0 Any other reports and records related to the administration of the drug <br />and alcohol testing program that may be required. <br />FirstLab will assist Participants in completing any state/federal audit <br />reports. <br />Expert Witness Testimony - FirstLab will provide expert witness <br />testimony if requested by MCIT or the respective Participant. <br />Education and training - FirstLab will provide education and training to <br />participating entities regarding their obligations under federal and state
