The <br />property was zoned and guided appropriately at the time 2765 Kelley Parkway to the <br />direct west was developed. The site plan approved for this property fully complied with <br />all B - 6 standards and included no variances from the code. <br />The applicant approached staff at approximately the one year mark inquiring of whether <br />an official extension would be required, as construction of the building was not in the <br />immediate future. After review of the documents it became clear that a formal extension <br />would benefit both parties as the expiration language in the approval Resolution stated ”if <br />substantial development has not occurred witliin one year after approval of PUD No. 3A <br />as set forth in the Platmed Unit Development No. 3A Agreement, the City Council may
