. • -V <br />CITY of ORONO <br />RESOLimON OF_THE CITY COUNCIL <br />S5 1 9NO. <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (A) <br />FILE NO. 1981 <br />WHEREAS, Todd R. Courneya (hereinafter "the apr licant") has an interest in <br />the property located at 4620 Tonkaview Une within the City of Orono and legally described as <br />follows: <br />Lot 1. Block 1, Lemmerman Addition, Hennepin County. Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the epplicam has applied to the City for a variance to Municipal <br />Zoning Code SecUon 10,24. Subdivision 5 (A) to peimit the constiucUon of a 30 x W <br />rSct on an undeveloped property to he located 25' from the street lot Ime instead of the <br />required 33’. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #1981. <br />The property is located in the LR-IB Lakeshore Residential Zo^g Wsiria <br />requiring 43,560 s.f. or one acre in area. The property consists of 20,900 s.f. <br />or .47 acres. <br />3.The Orono Planning Commission reviewed this application oii November 21, <br />1994 and January 17.1995 and recommended approval of the variance application <br />as amended based upon the following findings: <br />A. The property has been assessed for sewer and a sewer smb is avaUable at <br />Tonkaview T ^ne for new residential construction. <br />B.Lot 1 of the Ummerman Addition was created as a result of a lot me <br />rcanangement that divided the two lots along a namral division Ime <br />created by steep topographies. <br />Page 1 of 5
