Box 66 <br />Crystal Bay, Minnesota 55323 <br />Dear Council Members: <br />j'Ui <br />«/i?C <br />SUBJECT: NOTICE OF VIOLATION: Failure to Meet Bacteriological Monitoring Requirements, <br />Orono <br />According to our records, we did not receive the required number of monthly bacteriological water <br />samples for the month of June, 2005. United States Environmental Protection Agency (USEPA) rules <br />un^ 40 CFR 141.21 as implemented by Minnesota Rules, part 4720.0350, require your system to have <br />3 water sample(s) analyzed each month. To date, we have received the results for 2 sample(s). <br />Please note that all samples must be taken from representative sites on your distribution system. Any <br />two samples taken at the same site at the same time can only count as one sample. Furthermore, raw <br />water samples cannot be used to satisfy the bacteriological monitoring requirements. <br />Your system is ultimately responsible for ensuring that the Minnesota Department of Health (MDH) is <br />receiving a copy of your bacteriological results. Some laboratories do not mail results to the MDH. It <br />is your responsibility to send a copy by the tenth day of the following month, or verify that your <br />la^ratory is aware of this policy. <br />Community water supplies that fail to submit the required samples must provide public notification <br />(USEPA rules under 40 CFR 141 .32 as implemented by Minnesota Rules, part 4720.0350) to inform <br />their consumers that the required sampling was not done. If a community repeatedly fails to submit <br />samples, formal enforcement action, which may include fines, will be taken by either the USEPA or the <br />MDH. <br />A sample public notice is enclosed.
