SP <br />MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday* July 18,2005 <br />6:00 o'clock p.m. <br />10. 805-3129 ASCENT INVESTMENTS, INC., ON BEHALF OF DOUGLAS KLINT, 1345 <br />REST POINT LANE, VARIANCE, 8:08 P.M. - 8:13 P.M. <br />Kimberly Klint, Applicant, was present. <br />Gundlach stated the applicant is requesting lot area, lot width, and a front yard setback variance to allow <br />the construction of a new resident. Gundlach stated the lot is approximately one-half acre in size in a one <br />acre zone and is 76 feet in v/idth at the 7S-foot setback. The side street setback variance is being <br />requested to permit a front yard setback of 23 feet when 3S feet is normally required and three feet <br />currently exists. <br />Staff recommends approval of the request for the lot area and lot width variances, but recommends denial <br />of the side street setback variance. Gundlach noted the existing residence does not meet the required <br />setback but that there is adequate building area within the required setbacks to construct a reasonably <br />sized residence but would require a redesign of the house. <br />Mrs. Klint had nothing to add to Staffs report <br />There were no public comments regarding this application. <br />Rahn stated in his view there is an adequate building pad and that the lot is more suitable for a longer <br />shaped house. Rahn stated there does not appear to be a hardship inherent with the land. <br />Kempf stated he has seen more difficult building pads than this one and that some consideration should be <br />given to a different design. <br />Fritzler stated he would like to see the house be compliant with the setback. <br />Kempf moved. Rake seconded, to recommend approval of a lot width and lot area variance and <br />denial of a side street setback variance for Application 805-3129, Ascent Investments, Inc., on <br />bchatf of Donglas and Kimberly Klint, 1345 Rest Point Lane. VOTE: Ayes 6, Nays 1, Bremer <br />opposed. <br />Bremer stated she is opposed because of the unique shape of the lot. <br />PAGE 21
