r <br />MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, July 25,2005 <br />7:00 o’clock p.m. <br />(14. APPEAL OF ENFORCEMENT ACTION - 2600 CASCO POINT ROAD, Continued) <br />Though he believed the hillside and trees provided adequate screening, White asked if Raster was <br />willing to put up some additional screening. <br />Raster stated that he would if he must, but questioned why he would wish to draw attention to <br />something that is currently screened. <br />Curtis stated that the Ordinance states that special mobile equipment is prohibited from outdoor <br />parking or storage within the *R’ District. <br />Gafliron added that the Ordinance does not ‘grandfather’ special mobile equipment. <br />White stated that the Ordinance states it must be kept inside a building, pole shed, or other legal <br />accessory structure. <br />Sansevere asked if Raster had other storage options. <br />Raster stated that he uses die tractor in the winter mostly for snow removal. He questioned k>w, <br />after 30 years of owning his tractor, he was now considmd nonconforming and might be forced to <br />get rid of his piece of equipment. <br />Mayor Peterson asked whether the City could attach a timeline for its removal, say 10 years or <br />more. <br />Murphy suggested the City table the item and discuss die Ordinance during a work session. If <br />tabM, Raster could keep the tractor where it is currently until die City determines what to do in <br />various situations. He maintained that the City must enforce their Orchnances and support staff or <br />take more time to consider ramifications of certain Ordinances. <br />Moorse stated that staff and Council could take time to evaluate the Ordinance and, if an <br />amendment to the Ordinance is necessary, proceed in that direction. <br />Mnrphy moved. Mayor Peterson seconded, to table the Appeal Notice of Violation, pending <br />CUy Connell review of the Ordtnnnce. VOTE: Ayes 4, Nays 1, Sansevere dissenting. <br />Sansevere wished a time limit for teview be placed on the item. <br />*15. SEPTIC CODE AMENDMENT - ADD ENFORCEMENT LANGUAGE - <br />ORDINANCE NO. 27.3'^ SERIES <br />Murphy moved, Sansevere seconded, to adopt ORDINANCE NO. 27, Third Series, an <br />Ordinance Amending Chapter 58 of the Orono Municipal Code by Addiag Section 58-72, <br />Part C, Regarding Enforcement of Septic Code. VOTE: Ayes 5, Nays 0 <br />PAGE 7 of 10 <br />1
