5. <br />a. The applicants’ property is 0.47 acres in total area and has 61 ’ of width <br />at the shoreline and 125’ at the 75’ setback from the OHWL of Lake <br />Minnetonka. No additional land is available to make the property <br />nearer conformity as to area or width. <br />b. The existing stair within the 0*75’ zone will remain. <br />c. The boat house within the 0-75’ zone will be removed during the <br />winter of 2006 at such time when access can be gained from the lake <br />so as to avoid damage to the lake yard of the property. <br />d. The proposed home will meet all setback, hardcover, and lot coverage <br />requirements. <br />e. The site regarding in the 0-75’ zone after home and boathouse removal <br />is necessary in order to restore the site to appropriate grades. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the applicants and the public, and the effect of the proposed <br />variances and conditional use permit on the health, safety and welfare of <br />the community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance and conditional use permit would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to neighboring property; would not merely serve as a convenience <br />to the applicants, but is necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preserve a substantial propen.’ right of the <br />applicants; and would be in keeping with the spirit and intent of the <br />^ning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based iqx>n one or more of the above findings, the Orono City Council hereby <br />grants lot width and lot area variances and conditional use permit to Orono Municipal <br />Zoning Code Sections 78-330(B) and Section 78-1286 to allow construction of a new <br />single family residence on a lot 0.47 acre in area and has 61’ of width at the shoreline and <br />Page 2 of S <br />4
