The initial application made <br />included a conditional use permit for land alterations with the 0-75’ zone. Throughout <br />the review the applicant was unable to obtain a landscaper and/or engineer who could <br />draft the necessary plans for review by the City Engineer. Rather than hold up the <br />hardcover variance approval, and ultimately a full remodel of the applicant’s home, the <br />applicant chose to extend the 60-day review period indefinitely for the CUP portion of <br />the q)plication. The applicant has received a temporary Certificate of Occupancy and a <br />final is expected once final grading has occurred, following approval and implementation <br />of the proposed plans for the CUP. <br />CoaditioBal Use Permit ABalysis <br />The City Engineer has reviewed and approved the proposed plans. Zoning Ordinance <br />Section 78-1250 (1) establishes the following evaluation criteria for conditional uses <br />within the Shoreland Overlay District; <br />Evaluation criteria. A thorough evaluation of the water body and the topographic, <br />vegetation and soils conditions on the site must be made to ensure: <br />The prevention of soil erosion or the possible pollution of public <br />waters, both during and after construction; <br />The plans submitted indicate the erosion control methods <br />proposed The City Engineer has required that prior to any site <br />work the erosion control measures should be installed and <br />inspected. <br />b.The visibility of structures and other facilities as viewed from <br />public waters is limited; <br />Currently, a single railroad tie retaining wall exists which runs <br />perpendicular to the shoreline. This wall will be replaced with two <br />four foot boulder wall, also running perpendicular to the <br />shoreline. These walls are necessary due to the drastic changes in <br />grade from the high side of the wall to the low .side. The negative <br />visual impacts as viewed from the water are minimized as the walls <br />will run perpendicular to the shoreline and a planting plan is <br />proposed which will screen the walls. <br />c.
