r <br />I <br />FILE #05-3114 <br />11 May 2005 <br />Paga4of4 <br />The applicants require a considerably long driveway due to their proximity to North <br />Shore Drive and the configuration of the five properties served by this driveway. This <br />driveway could perhaps be a justification for some level of hardcover variance, although <br />the existing home (using essentially the same driveway) is under the 25% hardcover limit <br />for this zone. <br />The City has been consistent in attributing to a property’s hardcover calculation the <br />portion of the shared driveway and easement that exists within the property and is needed <br />to serve the property. We do not recommend changing that policy, as it is equitable in <br />most cases. However it may be useful to consider what would be allowed if the shared <br />driveway easement in this unique case had been configured as an Outlot. In that case, the <br />area of the 18’ wide driveway easement, and the area of the actual shared driveway <br />within it would be removed from the hardcover calculation. The 75’ - 250 ’ zone would <br />be reduced my approximately 3,600 s.f., and the 15’-17’ wide driveway would exclude <br />about 3,200 s.f. 7S’-250 ’ zone hardcover. The resulting 75’-250 ’ hardcover level would <br />be: 10,109-3,200/36,080 -3,600 6,909/32,480 » 21.3%. Although this method is not <br />the way hardcover is calculated for the current configuration, it illustrates the possible <br />hardship imposed by the shared driveway being • ained within this property as an <br />easement rather than an Outlot. <br />Issues for Consideration <br />1. Does the driveway configuration present a valid hardship to justify 28% <br />hardcover in the 75’-250 ’ zone? If not what areas of proposed hardcover can be <br />reduced to make the proposal conforming? <br />2. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Planning Staff recommends iqiproval of the lot width and average lakeshore setback <br />variances, and denial of the variance for hardcover in excess of 25% in the 75’ - 250 ’ <br />zone for this nearly conforming lot. <br />ft*,.?,. <br />Vi* <br />riv.- >V 3 <br />■''" <br />m
