June 7,2005 J(iN 0 8 <br />city OF <br />2005 <br />ORONo <br />To: Orono City Coundi <br />My name Is Stuart Harrington and I reside at 3135 North Shore Dr. I am the neighbor to the north <br />of Saver & Sharon Paterson at 3145 North Shore Dr. Many years ago an artificial pond, <br />eormactad by a channel to Lake Minnetonka, was dug on my property. This pond is between my <br />house and the lake and is immediately north and beside the Peterson home. <br />As 1 understand the Petersons are asking the city of Orono for a variance on their hardcover from <br />the 25% that Is required under the present ordinance to 28%. By the cit/s calculations the <br />Petersons were at 38% and have reduced that by 10 percentage points, which is more than a <br />25% reduction, to the present 28% calculation. <br />I also understand that by dty caioutations befbra the ordinance change the Petersons would have <br />only 21% hardcover. The reason for the difference is that the city changed their ordinance frtat <br />consequently irwiudes the five party common "driveway ”, and (I am one of the five), that is <br />entirely located on Peterson's property as hardcover allocated entirely and solely against the <br />Peterson ’s property. Obviously creating a hardship for the Petersons. <br />There is e second hardship for the Petersons. In the past, setback that affects hardcover <br />caleulations was measured from the lakeshore. Now it is measured from the artificial pond that <br />has been dug on my property. Again this is a hardship for the Peterson's property. <br />The Petersons have reduced their hardcover under the new ordinance by more than 25%. Thafs <br />incredible considering it is calculated under the two hardships they have. <br />I have seen the sketches of their proposed new home. It will enhance and complement our <br />neighborhood. <br />The Petersons should not be required to build a house smaller than what they have had. <br />Besides, a smaNer house would look odd and diminish the neighborhood. The Petersons could <br />legally narrow the common driveway that we all share and that would bring them under fr)e 25%. <br />I es weH as the Petersons, consider that an acceptable solutioni Please consider their hardship <br />situations and grant them a variance at 28% hardcover. <br />Thank you <br />JA <br />Stuart Harrington <br />Cc.
