VOTE: Ayaa-dT^^s 2, Bremer and KempfOppos^ <br />Brempadlaf^he would be in favor of the garage addition if there were reduCtioQS in hardcover. <br />7. 605-3111 WATER STREET HOMES, LCC ON BEHALF OF RANDALL AND <br />SARA HOGAN, 2260 FOX STREET, CONDITlCmAL USE PERMIT AND VARIANCE, <br />9:10 PM.-10:06 P.M. <br />Rick Carlaon, Water Street Homes, was present <br />Gafiron stated the applicants ate requesting a variance for an accessory structure located nearer the front <br />or street lot line than the principal residence structure and a variance to the allowed footprint area for an <br />oversize accessory structure. Additionally, a conditional use permit is requested for plumbing in an <br />accessory structure that includes a toilet. <br />Gaffron indicated the oversize accessory structure section of the zoning code does not specifically address <br />whether die lot area for purposes of establishing the allowed footprint area of accessory buildings is to <br />include or exclude wetlands. Therefore, based on the definition of lot area in the zoning code, wetland is <br />excluded and the non-wetland area within the property, not including the separate outlot driveway <br />corridor, is about 2.7 acres, which would allow an accessory structure with a footprint of 1,200 square <br />feet. If the total area of the lot and outlot including wetland is used, the lot at 4.985 acres would allow a <br />2,000 square foot footprint. <br />Gafiron stated the buried portions should be considered structure from a building code standpoint but that <br />the visual impacts of the building are limited. Gaffron pointed out that the intent of the ordinance was not <br />only to limit visual impacU but also to address or limit the uses associated with large structures.
