CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />O C> vl <br />No._iLii_:______ <br />MM <br />3. <br />**.v. <br />4. <br />The Orono Planning Commission reviewed this application on July 19, 1993 and <br />recommended approval of the proposed variances as amended based upon the <br />following findings: <br />A. The 4.9 acre parcel has approximately one acre of contiguous dry <br />buildable area . <br />B.Shoreland Regulations now require 100’ setback for all structures from the <br />Recreational Development lake that encroaches the property placing severe <br />restrictions on the building envelope and making existing structures non- <br />conforming. <br />C.The existing septic system has. been found to meet the 3’ separation <br />required by new Shoreland Regulations and septic code. <br />D. The majority of tne dry buildable area, approximately two-thirds of the <br />dry buildable envelope is located within the 0-75 ’ setback area where no <br />hardcover or structural improvements are allowed. <br />E.Structural setbacks for the newly classified shoreland property make it <br />unbuildable for new development. <br />F.Proposed structural improvements are at2,S62.6 s.f. or 6.2%, well under <br />the allowed 15% structural coverage. <br />G. Total hardcover based on the dry buildable portion of the 4.9 acre parcel <br />is proposed at 5,998.8 s.f. or 14.5%. <br />The City Council finds that the conditions existing nn tliis property are peculiar <br />to it and do not apply generally to other property . i this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
