Applicants shall remove all plastic or fabric liner material from the decorative <br />landscape beds on the property to ensure their permeability as non-hardcover <br />surfaces. <br />4. Required removals of hardcover shall be compi*?'.cd by the footing inspection for <br />the detached garage. <br />6. The applicants must provide and City staff must approve of a landscape plan <br />which will provide screening of the detached garage from the channel prior to the <br />issuance of a building permit for the detached garage. The approved landscape <br />plan must be implemented prior to a final inspection of the detached garage. <br />7. Authorities granted by this resolution run with the property not with the <br />applicants, but are permissive only and must be exercised by obtaining a building <br />permit for the new construction within one year of the date of Council approval, <br />or the variance will expire on that date (May 23,2006). <br />8. Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />termiruUe any authority granted herein, and shall be punishable as a misdemeanor. <br />9. The undersigned applicants have read, understand and hereby agree to the terms <br />of this resolution and on behalf of the rqiplicants and the applicants’ heirs, <br />successors and assigns, hoeby agree to the recording of this resolution in the <br />chain of title of the property. <br />Jt.Page 4 of6 <br />1 <br />5. Applicants are advised that the City Council intends that the level of structural <br />coverage approved via this variance is the maximum that should be approved for <br />this property, and future requests for additional structural coverage are not likely <br />to be approved. ____________________[
