MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Mosday, May 9,200S <br />7:00 o’clock p.in. <br />10. #05-3107 SCOTT BISSEN AND MICHELLE MOREY, 825 TONKAWA ROAD - <br />VARIANCE AND CONDITIONAL USE PERMIT - RESOLUTION NO. 5324 <br />Scott Bissen, Applicant, and JefTNute, Natural Environments, were present. <br />Curtis stated the qiplicant is requesting a conditional use permit in order to replace a rotted wooden stair <br />system with lower facial boulder walls, vegetation, re-grading of the slope, and installation of a granite <br />stair system. A hardcover variance is required due to the change in the hardcover percentage proposed. <br />The Planning Commission recommended approval of the hardcover variance and conditional use permit <br />per Staff's recommendation. <br />Curtis stated the applicant requested this item be removed from the consent agenda so they could address <br />condition number four, which reads as follows: “A permit will not be issued for the lake access stair until <br />after the completion of a framing inspection for the new residence.” Curtis stated this condition was <br />listed in the Planning Report dated April 11*^ on pages one and four. <br />Bissen stated he did qteak with Staff prior to purchasing this property regarding the lakeshore. Bissen <br />stated he found out today that he would not be able to construct a suirway to the lake until the house is <br />framed. Bissen indicated the builder was scheduled to construct the stairs next week and that a sizeable <br />deposit has been made. <br />Bissen stated construction on the house is not expected to commence until late June. Bissen indicated he <br />is unaware of the time frame involved with framing the house, noting that they are still in the process of <br />designing the house. Bissen stated Staff might have had the impression that the stairway was going to be <br />done in conjunction with the construction of the residence. Bissen stated the new stairway would '.ilow <br />them to eqjoy the property and also eliminate the unsafe suirway currently on the property. <br />Sansevere stated there could be delays that prevent construction of the residence and inquired whether <br />this would be a precedent. <br />Gaffron slated it could be a precedent since a suirway is considered structure and that typically work not <br />associated with the main residence is not allowed on the site due to the security of a property and the <br />potential for vandalism. <br />Bissen indicated he is new to the building process and that they would like to construct the deck prior to <br />work commencing on the residence so they would be able to enjoy the property this surruner. Bissen <br />suted the suirway would only improve the appearance and safety of the property. <br />Murphy inquired when building is anticipated to commence. <br />Bissen suted he is hoping to commence construction by the end of June. <br />Murphy inquired how long construction of the suirway is anticipated to uke. <br />PAGE 17
