MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, May 9,2005 <br />7:00 o’clock p.m. <br />(#04-3060 Mkhad aad Doaaa Ebcrtz, Coatiaaad) <br />Murphy stated in his opinion removal of the shed and the decks are a good starting point for reducing <br />hardcover on this lot. <br />Ebertz stated he would like some direction from the Council on the amount of hardcover that should be <br />removed. <br />Gaflhm stated there is existing hardcover in the 0-7S’ zone that is not necessary, noting there are two <br />platforms that are in poor condition and a 4’ by 10’ shed that also is in poor shape. Gaflron stated in his <br />opinion the shed and two platforms could be removed. Gaffron noted there also is a gravel road that <br />allows access to the lake ^t could be removed. <br />Ebertz inquired what the square footage would be for the platform. <br />Curtis stated the total of the decks on the lake is 305 square feet. <br />Ebertz stated he would not be agreeable to removing the two decks. Ebertz noted they do utilize the deck <br />quite a bit and that he has some items stored in the shed. <br />McMillan stated she would like complete removal of the two decks. <br />Murphy inquired what the square footage would be for the shed, both platforms, and the gravel road. <br />Curtis stated the total would be 11 SO square feet. <br />Morphy amved, Fetarsoa sccoadcd, to direct staff to draft a resointioa for AppUcatfoa #04-3060, <br />Michael and Doaaa Ebertz, 1220 Toakawa Road, graatlag of aa after-the-fact coaditloaal asc <br />penalt la order to coastract a hoalder wall aad re-grade the lake yard, aad graatlag of a hardcover <br />varlaacc sabjcct to the reamval of hardcover eqaivaleat to the anoaat of hardcover added to the <br />sUe by the rctalalag wall, aad farther sabject to reamval of the existing 4.5* by 10 ’ shed and two <br />decks. <br />Ebertz stated those removals add up to approximately 350 square feet and that m his view he is being <br />penalized. Ebertz noted one of the decks is used on a regular basis and that the deck is one of the reasons <br />why he purchased the property. Ebertz noted the deck has been re-stained iit the past and is scheduled for <br />re-sttining again in the near future. Ebertz stated he would rather forego die retaining walls than remove <br />the deck. Ebertz stated there is an expense associated with removing the deck and that the removal of the <br />deck would reduce the value of the property. <br />Ebertz noted a large portion of the property is located within the 0-75’ zone. Ebertz stated he was not <br />aware that boulders are not allowed in that area. <br />White suggested the road be removed, one deck, and the shed. White stated the runoff from the gravel <br />road is a bigger issue than runoff from the deck. <br />PAGE?
