A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1288 AND <br />A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH SECTION 78-1286 <br />FILE NO. 05-3074 <br />WHEREAS, Sean S. Wambold and Melissa Wambold, husband and wife <br />(hereinafter “the applicants”) are the owners of the property located at 1379 Park Drive <br />within die City of Orono (hereinafter the “City ”) and legally described as follows: <br />Lots 13, 14 and IS, Block 6 and Lots 14 and IS, Block 7, in Saga Hill Revised, <br />together with that portion of Vacated Oak Place lying between the extensions <br />Southeasterly across it of the Northeasterly line of Lot 13, Block 6 and the Southwesterly <br />line of Lot IS, Block 6. Also together with that part of vacated Forest Boulevard as <br />dedicated in the plat of “Saga Hill Revised, Hennepin County, Minnesota” which lies <br />between the Northwesterly extensions across it of the Southwesterly line of Lot 1S, Block <br />6, “Saga Hill Revised, Hennepin County, Minnesota” and the Northeasterly line of Lot <br />13, said Block 6, Hennepin County, Minnesota (hereinafter the “property”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for variances and conditional use permit to Orono Municipal Zoning Code Sections 78- <br />1288 and Section 78-1286 to allow retaining walls within 75* of the OHWL of Lake <br />Minnetonka and within the 75’-250* zone requiring hardcover variances for both the 0- <br />75* and 75*-250* zones and a conditional use permit to allow grading within 75* of the <br />OHWL. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #05-3074. <br />2. The property is located in the LR-IB, One Family Lakeshore Residential <br />District, which requires a minimum lot area of 1.0 acres.
