MN 55331 <br />COPIES:Paul Overson <br />14821 Maywood Drive <br />Burnsville, MN 55306 <br />TYPE OP APPLICATION:Conunercial Site Plan Review <br />DATE OF MEETING: March 28,2005 VOTE: 5 FOR 0 AGAINST <br />Modoa: To direct staff to draft a resolution iqiproving the commercial site plan and <br />occiqMUicy permit request with the following conditions: <br />• The Shareo Parking Space License Agreement is redrafted to include permission for <br />business invitees to access the shared parking spaces as well as the parking spaces <br />located on the Overson site, and also clarification that the shared spaces on the <br />Keaveny site exist at the lower level parking area. The agreement should be drafted <br />for use of 9 paridng stalls, have a current date, and signed by all parties. A copy of <br />this agreement should be submitted to the City. <br />• The entire parking lot on site (including upper and lower levels) is striped to <br />formalize the location of available parking spaces. <br />• The dumpster located on site is moved to a location that would not obstruct available <br />parking spaces. <br />• The applicant sign an addendum to the Parking Space License Agreement which <br />states a voluntary vacation of the retail space should the Parking Space License <br />Agreement termirrate. This agreement must include language regarding payment of <br />City court and attorney fees should the City be required to take action in forcing the <br />vacatiotL This document shall be recorded against the chain of title for the property. <br />• The site complies with Sections 58-1 and 58-3 regarding maintenance of private <br />property. <br />Applicant's next scheduled meeting is confirmed as: <br />City Council - Monday, April 11, 2005; meeting starts at 7:00 p.m. for <br />adoption of the approval resolution. <br />If you desire certified copies of the official Council minutes, they are available from the <br />City Clerk after review and approval by the City Council.
