Stairways, lifts and landings. <br />Stairways and lifts are the preferred alternative to major topographic alterations <br />for achieving access up and down bluffs and steep slopes to shore areas. Stairways, lifts <br />and landings shall be allowed in the shore setback zone and must meet tire following <br />design requirements: <br />(1) Stairways and lifts must not exceed four feet in width. <br />Landings for stairv/ays and lifts shall not exceed 32 square feet in area. <br />Canopies or roofs are not allowed on stairways, lifts, or landings. <br />Stairways, lifts and landings may be either constructed above the ground <br />on posts or piling” or placed into the ground, provided they are designed <br />and built in a manner that ensure, control of soil erosion. <br />Stairways, lifts and landings must be located in the most visually <br />inconspicuous portions of lots, as viewed from the surface of the public <br />water, assuming summer, leaf-on conditions, whenever practical. <br />Facilities necessary to provide shore area access to physically handicapped <br />persons shall be allow^ provided that the dimensional a** J pertbrmance <br />standards of subsections (1)~(S) of this section are completed in addition <br />to the requirements of the Minnesota Regulations, chapter 1340. <br />A building permit shall be obtained for construction of stairways, lifts and <br />landings regardless of whether such improvements are constructed above, <br />at or below grade. <br />Sec. 78-1286. Topographic alterations/grading and filling. <br />(b.) Grading, filling or excavating of more than ten cubic yards is prohibited within 75 <br />feet of the ordinary high water level of the public waters enumerated in section 78-1217. <br />Grading, filling or excavating of ten cubic yards or less shall require city staff review and <br />permit and be si bject to other pertinent sections of this chapter. <br />Sec. 78-1288. Hard cover limitatioHS. <br />a) No hard cover or impervious surface shall be placed, located or constructed <br />within 75 feet of the ordinary hi^ water level of any lake or tributary, except for <br />stairways, lifts, landings and lockboxes as regulated elsewhere in this Code. <br />b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than 25 <br />percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no <br />greater than 30 percent hardcover. Between 500 feet and 1,000 feet of the OHWL <br />there shall be no greater than 35 percent hardcover. <br />,v'V ‘ <br />i <br />M
