¥ <br />r <br />t <br />1. Council approval is based on the site plan submitted by the applicant and <br />annotated by City staff, attached to this Resolution as Exhibit A. Any <br />amendments to the site plan which are not in conformity with City codes will <br />require further Planning Conunission and City Council review. <br />2. Hardcover in the 0-7S* zone shall not increase above the level of 0 s.f or 0%. <br />Hardcover in the 7S*-2S0 ’ zone shall be limited to 25% per Zoning Ordinance <br />regulations and the pool shall be constructed on the property in accordance with <br />Exhibit A. <br />3. The shed located along the southerly property boundary next to the garage shall <br />be moved to meet a 10* setback from the side lot line, and be no closer to the <br />garage than 10*. The shed shall be moved prior to issuance of a building permit <br />for construction of the pool. <br />4. Audiorities granted by this resolution run with the property not with the <br />applicants, but ue permissive only and must be exercised by obtaining a building <br />permit for die new construction within one year of the date of Council appro' il, <br />or the variance will expire on that date (April 25,2006). <br />S. Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />6. The undersigned qiplicants have read, understand and hereby agree to the terms <br />of this resolution and on behalf of the applicants and die applicants* heirs, <br />successors and assigns, hereby agrees to the recording of this resolution in the <br />chain of tide of the property. <br />Page 3 of 5
