«iB» I ^ • fwt t t «w « <br />EXHIBIT B <br />PARKING SPACE UCENSE AGREEMENT <br />I <br />Parking Space License Agreement ("Agreement”) between The Richard M. Kcaveny <br />Fanyly Limited Partnership, as “Licensor," and JuIAim, Inc., d/b/a Jul Ann Hair Fashions, as <br />“Licensee.” <br />Licensor owns the real property at 3421-3435 Shoreline Drive in the City of Navarre, <br />MiiyiesoU, legally described as; Tract B, Registered Land Survey No. 1422, Hennepin County, <br />Mirinesota (hereafter “Licensor ’s property”). Licensee is or will be a tenant of the property that is <br />located at 3449 Shoreline Drive and which is adjacent to Licensor ’s property (hereafter the <br />“neigliboriug property"). <br />' The parties agree as follows: <br />^ 1. License. Licensee snail have a license for the use of up to __par’icing spaces in <br />the parking area on Licensor ’s property that is adjacent to Shoreline Drive (hereafter the <br />“Li^nse”), by employees or clients of Licensee’s hair salon (to be) operated on the neighboring <br />property, subject to the terms of this Agreement. <br />2. License Fee. Licensee will pay Licensor a license fee of $___per month, on or <br />before the____day of the month, for each montli tlie License is in effect. The license fee for any <br />pamal month will be pro-rated. The License fee will be subject to adjustment evciy twelfth <br />month that the License is in effect, by not more than a cumulative total of 5% per year. <br />3. Terminarion: Term. The License will terminate if Licensee is delinquent in the <br />payment of the monthly license fee or in any other obligation of Licensee pursuant hereto, and <br />continues to be delinquent after ten days written notice to Licensee delivered or mailed to <br />Licensee at Licensee’s last known address. Licensor (or Licensor ’s successors or assigns) may <br />alsq terminate the License upon, or at any time after, the occurrence of any of the following <br />con|ditions: <br />(a) Licensor sells Licensor ’s property; <br />(b) Licensor enters into a lease with a tenant who will occupy the lower Uivcl, or any <br />part of the lower level, of the building on Licensor ’s property, and such tenant <br />commences occupancy; <br />(c) Licensor, or the present or future tenants of Licensor ’s property, need to have the <br />licensed paraing spaces available in order to s;>.tisfy zoning other requirements <br />of any governmental authonty' (whethe. due to a change in tl.. use or size of tl'.e <br />building, change or application ot zoning requirements, or othei wise), <br />(d) Licensor commences rc">ovaI, reconstruction, substantial remodeling, or any <br />addition to, Uic existing building or other improvements on Licensor ’s property; <br />(e) Any part ol Licensor ’s property is condemned or taken, either temporarily or <br />permanently, by any governmental authority. <br />Ter|miiiation pursuant to (a) through (e) above will become effective ten days after wiitten notice <br />to l^icensee delivered or mailed to Licensee at Licensee’s last known address, and, Licen.sec <br />expressly agrees that Licensee has no riglits or expectation whatsoever which would in any way <br />impede Licensor from selling, leasing, removing, expandmg, remodeling or recon.structing the <br />buijding or other improvements on Licensor ’s property and terminating the License by reason <br />thereof Licensee also agrees tliat the License is personal to Licensee and will automatically <br />teiminate if Licensee i eases to operate a IilIi salon on the n'‘ighboring property, for any reason,
