Hardcover variance to pennit 35.9% hardcover within the 75’-250’ hardcover <br />zone when 31.6% currently exists and 25% is normally allowed. <br />2. Average lakeshore setback variance to permit both additions to be constructed in <br />front of the average lakeshore setback line. <br />Staff Recommendation: Staff recommends the following; <br />1. Denial of the hardcover variance request as no valid hardship has been <br />demonstrated to allow an increiise above the existing non-conforming 31.6% <br />level. <br />2. Approval of the average lakeshore setback variance as the property sits on a point <br />where almost the entire lot is closer to the lake than the neighboring homes. <br />The applicant is advised to revise the plans to incorporate hardcover removals so that the <br />hardcover level does not exceed the current 31.6%. <br />Pertinent Zoning Ordinance Sections <br />Sec. 78-1288. Hard cover limitations. <br />(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than 25 <br />percent hard cover. Between 250 feet and 500 feet of the OHWL there shall <br />be no greater than 30 percent hardcover. Between 500 feet and 1,000 feet of <br />the OHWL there shall be no gteater than 35 percent hardcover. <br />Sec. 78-1279. Placement of structures on lots. <br />(6) Average lakeshore setback.
