26. Assigaability. Hie Developer may not assign tiiis Contract witliout tlie written permission <br />oftlie City Council. Hie Developer ’sobligationhcrcundcrshall continue in full force and elTect even ifthe <br />Developer sells the entire plat, or any part of it. <br />27. Miscellaneous. <br />A. Construction Trailers. Placement of on-site construction trailers and temporaryjob site <br />offices shall be approved by the City Engineer as apart of the pre-construction meeting for installation of <br />public iniprovcments. Trailers shall be removed from the subject property within thirty (30) days following <br />the acceptance of the public improvements unless otherwise approved by the City Engineer. <br />B. Postal Service . The Developer shall provide for the maintcnunceofpostui service in <br />accordance with the local Postmaster's request. <br />C. Insurance. Developer shall take out and maintain until six (6) montlis after the City has <br />accepted the public improvements, public liability and property damage insurance covering personal injuiy, <br />incl iding death, and claims for property damage which may aii.seoutof Developer ’s work or the work of <br />its subcontractors or by one directly or indirectly employed by any of them. Limits for bodily injury and <br />death shall be not less than $500,000 for one person and $ 1,000,000 for each occurrence; limits for <br />property damage shall be not less than $500,000 for each occurrence; or a combination single limit policy <br />of $ 1,000,000 or more. Tlie City shall be named as an additional insured on tlic policy, and tlie Developer <br />shall file with the City a certi ficate evidencing coverage prior to the City signing tlie plat. Tlie certi ficate shall <br />provide that the City must be given ten (10) days advance written notice of the cancellation of the <br />insurance. The certificate may not contain any disclaimer for failure to give the required notice. <br />D. Construction Hours . Construction hours shall be from 7:00 a.m. to 8:00 p.m. on <br />weekdays, and from 8:00 a.m. to 8:00 p.m. on weekends and holidays per the provisions of Orono <br />Municipal Code Section 58-121. Under emergency conditions, this limitation maybe waived by the <br />consent of the City Administrator. Any approved work perfonned after dark shall be adequately <br />illuminated. <br />n. Noise Amplification . The use of outdoor loudspeakers, bullhorns, intercoms, and <br />similar devices ispiohibited in conjunction with the conslniction ofbuildings and the improvements required <br />under this contract. <br />F. Storm Sewer Maintenance. The Developer shall be responsible for cleaning and <br />maintenance of the stonn sewer .system (including ponds, pipes, catch basins, culverts and swales) within <br />the Projierty. <br />G. Soil Conditions . 'fhe Developer acknowltxlges that the City makes no re|ii esentations <br />or warranties as to the condition ot the soils on the property or its fitness for construction of the <br />improvements or any other purpose for which the Developer may make use vjf such property.
