,i <br /> . 04i. <br /> (0 , 0 <br /> 4 <br /> .., _ CITY of ORONO <br /> A <br /> *$' <br /> \ti Ile 0 RESOLUTION OF THE CITY COUNCIL <br /> 4, <br /> N.��kLSKo NO. 4 6 <br /> A RESOLUTION AUTHORIZING THE TAKING OF LAND BY <br /> EMINENT DOMAIN FOR ROAD, TRAIL, DRAINAGE AND UTILITIES <br /> EASEMENT PURPOSES RELATED TO THE SAGA HILL PARK AREA <br /> WHEREAS,the City Council has ordered preparation of a resolution authorizing taking of <br /> land by eminent domain for road, trail, drainage and utilities easement purposes at the location <br /> hereinafter specified, therefore, <br /> BE IT RESOLVED, by the City Council of Orono: <br /> 1. That it is hereby determined that the taking of the two parcels of land set forth in paragraph <br /> 3 hereof is necessary for the public good in order that said parcels shall be devoted to road, <br /> trail, drainage and utilities purposes. <br /> 2. That the City shall take by right of eminent domain for road, trail, drainage and utilities <br /> easement purposes, the land described in paragraph 3 hereof, and the City Attorney be <br /> hereby authorized and directed to commence proceedings in the District Court of Hennepin <br /> County for appointment of Commissioners to determine the damages, if any, sustained by <br /> the respective owner and interests of the parcel affected by such taking,as authorized by law. <br /> 3. A permanent easement for road, trail, drainage and utilities purposes for the benefit of the <br /> public, over, under, and across the Property in Section 7, Township 117, Range 23 legally <br /> described as follows: Beginning at a point distant 2224.4 feet southerly from the north line <br /> of the section along a line running from a point in the north line thereof distant 402.5 feet <br /> east from the northwest corner thereof to a point in the south line of the northwest quarter <br /> distant 396.5 feet east from the southwest corner thereof; thence southerly along said line to <br /> the north line of Bergquist and Wicklund's Addition to Bergquist and Wicklund's Park, <br /> Hennepin County, Minnesota; thence westerly along same and along the north line of <br /> Bergquist and Wicklund's Park,Hennepin County,Minnesota,to the west line of the section; <br /> thence north along said section to a point in a line running west parallel with north line of <br /> section from point of beginning; thence east to beginning, except road, Hennepin County, <br /> Minnesota, according to the plat thereof on file or of record in the office of the Registrar of <br /> Titles in and for said County. The easement area is that portion of the Property lying east <br /> and south of the following described Line A; Commencing at the northeasterly corner of the <br /> Property;thence south along the east lot line of the property a distance of 122.61 feet to the <br /> Page 1 of 2 <br />
