His analysis was that the existing septic system was sized for the church and day <br />care use but was considered non-compliant. However, the system would not require <br />upgrading until 2010 unless the use on tlie site was increased or tiiere were major <br />building expansions. The propo.scd 69 student day care use does not constitute a trigger <br />for system upgrade at this time. <br />Hardship Analysis <br />/« comMering appUcuUom for variance, the Piaanhig Coiiunissioii shall consider the effect of the <br />proposed variance upon the health, safety and welfare 'tflhe conununity, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in <br />the surrounding area. The Planning Commission shall consider recommending approval for variances <br />from the literal provisions of the Zoning Code In Instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the Individual property under consideration, and <br />shall recommend approval only when It Is demonstrated that such actions will be in keeping with the <br />spirit and Intent of the Orono Zoning Code. <br />Staff finds that as a conditional u.se permit currently exists on the property for 30 students <br />within an operating church, expanding the student enrollment level to 69 as the sole use <br />for the property is not too intense of a u.se and will not have a detrimental impact on <br />surrounding properties. The proposal meets or exceeds the requirements of the City Code <br />regarding day cares, and conditional u.ses within residential districts <br />Additionally, quite often the needs of the institutional uses within the residential districts <br />are not met under the current sign regulations. Variances have been consistently granted <br />for the difTerent sign needs for the varying institutional uses within the City of Orono in <br />the past, and perhaps this is indicative of the need to update the codes with respect to <br />institutional u.ses within residential zones. <br />I.S.SUCS fur Consideration <br />1. Does tlie Plamiing C’ommission have any concerns regarding tlic proposed <br />permanent or temporary signage? If appropriate. Planning Commission should <br />discuss standards for temporary signage, i.c. timeline, size, type. <br />2. Does the Planning Commission have any concerns regarding parking or access to <br />the site? <br />3. Arc there any other issues or concerns with this application? <br />Staff Recommendation <br />Planning Staff recommends approval of the conditional use permit amendments and sign <br />variances following the Planning Commission ’s guidelines for temporary sign usage <br />(size, timeline, etc) subject to: <br />1 . Licensing with the Department of I luman Services, and <br />2. Maximum enrollment of 69 students. <br />1
