1. Council iipproval is based on the site plan siihinitted by the applicant and <br />annotated by City slaiT, attached to this Resolution us Exhibit B. Any <br />unicndments to the site plan which are not in eonfbrniity with ('ity c<'des will <br />require further Plaiinin^ Commission and City ('oiaieil review. <br />2. Hardcover in the 0-7S ’ /one .shall not inerea.se above the 10.79%. Hardcover in <br />the 75-250 ’ /.one shall be limited to 7,43.1 s.f. or 26.76% per the proposed plan <br />and hardcover allowance .summary as depicted in Ke.solution /M604 and on <br />Exhibit H. Applicant is advi.scd that any future requests to increase hardcover or <br />change the nature of cxisting/approved hardcover shall require ('ity approval, and <br />increases in liardcover will not likely be approved without concurrent reduction in <br />existing hardcover. <br />3. Applicant shall remove all phcstic oi fabric liner material from the decorative <br />landscape beds on the pro|K*rty to ensure llicir jKnneability as non-hardcover <br />surfaces. <br />4. The applicant shall remove 100 s.f. of driveway bituminous within the 0-75 ’ zone <br />as depicted on l’)xhibit H. <br />5. Applicant is advised that the intent of the City Council is to not allow the wrought <br />iron deck to be converted to a poich of any kind, and any future variance request <br />to do .so is not likely to be approved. <br />6. Ke(|uired removals of banlcover shall be completed by the first inspection of tire <br />propo.scd wrought iron deck. <br />7. Autluirities granted by this lesolution run with the property not with the applicant, <br />but are permissive rmly and must be exercised by obtaining a building permit lor <br />the new constiuction within one year of the dale of Council approval, or the <br />variance will expire on that dale (l•ebruary 2H, 2006). <br />8. Violation of or noii-conipliancc with any of the terms and conditions of this <br />resolution .shall coiustitutc a violation of the zoning code, .shall automatically <br />terminate any authority grained herein, and sliall be punishable as a mi.sdcnicanor. <br />9.
