Hardcover in the 0-7S ’ /one .shall not inerea.se above the 10.79%. Hardcover in the 75-250 ’ /.one shall be limited to 7,43.1 s.f. or 26.76% per the proposed plan and hardcover allowance .summary as depicted in Ke.solution /M604 and on Exhibit H. Applicant is advi.scd that any future requests to increase hardcover or change the nature of cxisting/approved hardcover shall require ('ity approval, and increases in liardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Applicant shall remove all phcstic oi fabric liner material from the decorative landscape beds on the pro|K*rty to ensure llicir jKnneability as non-hardcover surfaces. 4. The applicant shall remove 100 s.f. of driveway bituminous within the 0-75 ’ zone as depicted on l’)xhibit H. 5. Applicant is advised that the intent of the City Council is to not allow the wrought iron deck to be converted to a poich of any kind, and any future variance request to do .so is not likely to be approved. 6. Autluirities granted by this lesolution run with the property not with the applicant, but are permissive rmly and must be exercised by obtaining a building permit lor the new constiuction within one year of the dale of Council approval, or the variance will expire on that dale (l•ebruary 2H, 2006). 8. Violation of or noii-conipliancc with any of the terms and conditions of this resolution .shall coiustitutc a violation of the zoning code, .shall automatically terminate any authority grained herein, and sliall be punishable as a mi.sdcnicanor. 9.
