FILE WOfi‘3072 <br />3 January 2005 <br />Page 4 o( 5 <br />Aiictitionally, Scc(ioi) 78-916 stales that a conditional use pennit may be revocable, may <br />be granted for a limited time, or may be granted subject to such conditions as the council <br />may prescribe; and a conditional use pennit shall remain in effect as long as the <br />conditions agreed upon arc observed, but nothing in this section shall prevent the city <br />from enacting or amending official controls to change the status of conditional uses; and <br />a certified copy of any conditional use permit shall be filed with the county recorder or <br />registrar of titles. The conditional use permit shall include the legal description of the <br />properly included. <br />Sign Size Variance <br />The Orono sign ordinance docs not address the needs of institutional uses within <br />residential /ones. Currently the .school has a campus sign peipcndicular to Highway 12 <br />in front of the tennis courts. 'I he existing sign is approximately 41 s.f. total area and <br />contains a manual readerboard. <br />The applicant has proposed a monument sign ap|)roximately 9 ’ high and 11* wide. The <br />propo.scd sign meets City Code Section 78-1466(11) regarding monument signs. The <br />proposed sign copy area 56 s.f. with a 30 s.f. static electronic readerboard. The applicant <br />has indicated that this readerboard is to be changed no more frequently than once daily <br />and its pur|)ose is to provide |)arcnts and students with relevant school information. The <br />electronic readerboard will eliminate the need for sending a student or staff member out <br />to the sign to physically change the message on the sign and will be more functional for <br />the school. As proposed the sialic electronic readerboard is no: considered a “flashing <br />illuminated .sign ” which is not allowed. <br />Hardship Stulcmeiit <br />Applicant has completed the Hardship Documentation I'omi attached as Exhibit B, and <br />should be asked for additional testimony regarding tbe application. <br />Hardship Analysis <br />III coiixiilt'riiifi applu alioiis for variance, the Planning Coininhsion shall consider the effect of the <br />proposed variance upon the health, sajety and welfare of the coininnnity, evisting and anticipated traffic <br />conditions, tight and air, danger offire, risk to the public safety, and the effect on values of property in <br />the surrounding area. The Planning Coiniuissioii shall eonsider recoininending approval for variances <br />from the literal provisions of the /oniiig Code in instances where their strict enforcement would cause <br />undue hardship because of circumstances nnigue to the individual property under consideration, and <br />shall recommend approval only when it is demonstrated that sueh aetions will he in keeping with the <br />spirit and Intent of the Orono Honing Code. <br />Staff finds that olkn the needs ol the institutional uses within the residential districts are <br />not met under the current .sign regulations. Variances have been consistently granted for <br />the dilferent sign needs for the varying institutional uses within the City of Orono in the <br />past, and perhaps this is indicative of the need to update the codes with respect to <br />institutional uses within residential /ones.
